Megeventdecor – Terms & Conditions of Hire & Booking

These Terms & Conditions apply to all bookings made with Megeventdecor (“the Company”, “we”, “us” or “our”). By making a booking, paying a deposit or making any payment towards your booking, you (“the Client”, “you” or “your”) confirm that you have read, understood and agreed to these Terms & Conditions.

1. Booking & Acceptance of Terms

1.1 A booking is not confirmed until the required payment or deposit has been received and the Company has confirmed the booking.

1.2 By paying a deposit, balance or entering into an agreed payment plan, you confirm that:

  • You have read and accepted these Terms & Conditions.
  • You are aged 18 or over and legally able to enter into a contract.
  • You accept responsibility for all hired items for the duration of the hire period.
  • All information provided to the Company is accurate and complete.

1.3 No booking is considered confirmed until payment has been received.

1.4 Items remain subject to availability until the booking has been confirmed.

2. Hire Period

2.1 The hire period runs from the agreed delivery/setup time until the agreed collection time.

2.2 Unless otherwise agreed in writing, hired items must remain at the agreed venue and must not be moved to another location.

2.3 Hired items must not be altered, dismantled, repaired, decorated or otherwise modified without prior written permission from the Company.

3. Payment Terms

3.1 Full payment is required to secure a booking unless a deposit or payment plan has been agreed in writing.

3.2 Where the total booking value exceeds £100 and the event is more than one month away, a payment plan may be available upon request and at the Company’s discretion.

3.3 Where a payment plan is agreed, the first 50% payment is non-refundable.

3.4 All invoices must be paid by the due date stated on the invoice.

3.5 If payment is not received by the required date, the booking may be treated as unconfirmed and the Company reserves the right to cancel or release the date.

3.6 Payment is accepted by bank transfer unless otherwise agreed.

3.7 Card payments may incur an additional transaction fee where applicable.

3.8 PayPal, cash and cheques are not accepted unless otherwise agreed in writing.

4. Delivery, Setup & Collection

4.1 Delivery within a 10-mile radius of Somerton is charged at £5.00.

4.2 Beyond 10 miles, a delivery charge of £1.25 per additional 2 miles will apply.

4.3 Where Company setup is required, an additional setup fee may be charged depending on the size, complexity and time required.

4.4 If equipment requires collection after the event, the collection fee will be charged at the same rate as the applicable delivery fee, unless otherwise agreed.

4.5 The Client is responsible for providing safe, suitable and unobstructed access for delivery, setup and collection.

4.6 The Client must ensure that the Company can access the venue at the agreed times. Any delays caused by the Client, venue, guests, parking restrictions or lack of access may result in additional charges.

4.7 If the Client is not present or access is unavailable at the agreed delivery/setup time, the Company may need to rearrange delivery or collection. Additional charges may apply.

4.8 Delivery and setup fees are non-refundable once the service has been carried out.

4.9 If the Client fails to attend an agreed collection time, no refund will be issued and an additional collection charge may apply.

5. Cancellations, Refunds & Rescheduling

5.1 All cancellations must be made in writing.

5.2 If a booking is cancelled 14 days or more before the event, a partial refund may be issued, less any costs already incurred by the Company, including materials, stock purchases, preparation time, labour and other non-recoverable expenses.

5.3 If a booking is cancelled less than 14 days before the event, only 20% of the total booking value will be refunded.

5.4 Deposits and first payments made under an agreed payment plan are non-refundable, subject to any rights the Client may have under applicable law.

5.5 Rescheduling may be offered at the Company’s discretion and is subject to availability.

5.6 Where a booking is rescheduled, additional costs may apply where the new date requires different stock, materials, delivery arrangements or preparation.

5.7 The Company reserves the right to cancel a booking in exceptional circumstances where it is unable to fulfil the booking. Where the Company cancels, any payments made for services that cannot be provided will be refunded, subject to applicable law.

6. Balloons & Display Care

6.1 Balloons and certain decorative materials are naturally affected by temperature, humidity, sunlight and environmental conditions.

6.2 Balloons must be kept away from heat sources, naked flames, radiators and direct sunlight.

6.3 Balloons naturally expand and contract with temperature changes and may pop, deflate or change appearance.

6.4 Oxidisation, which may cause latex balloons to develop a cloudy or matte appearance, is a natural process and is not considered a fault.

6.5 Once balloons or displays have been delivered, installed or collected by the Client, responsibility for their care passes to the Client for the duration of the hire period.

6.6 Balloons, props and decorative items are not toys and must be kept away from children and animals.

6.7 Children and animals must be supervised around displays at all times.

6.8 Displays must not be stored overnight in vehicles, sheds or unsuitable outdoor spaces unless specifically designed for outdoor use.

7. Damage, Loss & Responsibility During Hire

7.1 All hired items remain the property of Megseventdecor at all times.

7.2 Risk and responsibility for hired items passes to the Client from delivery/setup until collection, unless otherwise agreed in writing.

7.3 The Client is responsible for any damage, loss, theft, interference, dismantling, tampering, misuse or accidental damage occurring during the hire period.

7.4 This includes damage to internal mechanisms, structural elements, bolts, fixings, electrical components and decorative features.

7.5 Accidental damage does not remove the Client’s liability for the resulting repair or replacement costs.

7.6 Where an item is repairable, the Client will be responsible for the reasonable full cost of repair.

7.7 Where an item is damaged beyond repair, lost or stolen, the Client will be responsible for its reasonable replacement cost based on its current value.

7.8 Any invoice for damaged, lost or stolen items must be paid within 7 days of the invoice date unless otherwise agreed.

7.9 Failure to pay amounts due may result in further recovery action and reasonable recovery costs may be added where permitted by law.

8. Wall Fixings, Adhesives & Venue Surfaces

8.1 By booking, you agree to the possible use of adhesive hooks, command hooks, removable adhesives, temporary fixtures or similar methods where required for installation.

8.2 The Company will take reasonable care when installing displays.

8.3 The Client is responsible for informing the Company of any venue restrictions, fragile surfaces, wallpaper, paintwork, specialist finishes or other relevant information before installation.

8.4 The Company is not responsible for minor cosmetic damage caused by temporary fixtures where reasonable care has been taken.

8.5 Where venue permission is required for fixings, adhesives or installation methods, it is the Client’s responsibility to obtain that permission before the event.

9. Safety & Allergies

9.1 Balloons and decorative items may present a choking hazard.

9.2 Balloons must be kept away from young children and pets.

9.3 The Client must inform the Company of any known latex allergies or other relevant allergies before booking.

9.4 Where no allergy or relevant medical information has been disclosed to the Company, the Company cannot accept responsibility for a reaction resulting from an undisclosed allergy, subject to applicable law.

9.5 Displays must not obstruct fire exits, emergency routes, fire extinguishers, access points or other safety equipment.

9.6 The Company reserves the right to refuse or alter an installation if it considers the proposed setup to be unsafe or unsuitable.

10. Venue Requirements & Client Responsibilities

10.1 The Client is responsible for ensuring that the venue permits the booked decorations and installation methods.

10.2 The Client must provide accurate venue information, including access restrictions, stairs, parking arrangements, loading areas and any relevant venue rules.

10.3 The Company is not responsible for delays or additional costs caused by incorrect or incomplete information supplied by the Client.

10.4 The Client must ensure that guests, children and animals do not interfere with displays or hired equipment.

10.5 The Client must not move, dismantle or alter any Company display unless permission has been given.

11. Photographs & Evidence of Condition

11.1 The Company reserves the right to photograph hired items before delivery/setup and after collection as evidence of their condition.

11.2 Photographs may be used to document damage, loss or disputes relating to the condition of hired items.

11.3 Where appropriate, the Company may also take photographs of completed displays for its business portfolio, website or social media. Where identifiable individuals are visible, appropriate permission will be obtained where required.

12. Limitation of Liability

12.1 The Company will take reasonable care in providing its services but will not be responsible for indirect or consequential losses, loss of enjoyment, loss of income or other losses arising from circumstances outside its reasonable control, except where liability cannot legally be excluded.

12.2 The Company’s liability will not exceed the total amount paid by the Client for the booking, except where a higher level of liability is required by law.

12.3 Nothing in these Terms & Conditions excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot legally be excluded or limited.

13. Unforeseen Circumstances & Force Majeure

13.1 The Company will not be liable for failure or delay in performing its obligations where this is caused by circumstances beyond its reasonable control.

13.2 Such circumstances may include severe weather, flooding, fire, transport disruption, venue closure, power failure, illness, accident, government restrictions, natural disasters or other unforeseen events.

13.3 Where such circumstances occur, the Company will make reasonable efforts to communicate with the Client and, where possible, offer an alternative arrangement.

14. Amendments to Bookings

14.1 Any changes to a booking, including changes to date, venue, items, quantities, colours or setup requirements, must be agreed in writing.

14.2 Changes may result in additional charges.

14.3 The Company cannot guarantee that requested changes will be possible, particularly where the original event date is approaching or stock has already been prepared or purchased.

15. Complaints

15.1 Any complaint regarding the Company’s services should be raised with the Company as soon as reasonably possible.

15.2 Where there is an issue with a display or service, the Client should contact the Company before attempting to alter, repair or dismantle the display.

15.3 The Company will make reasonable efforts to investigate and resolve genuine complaints fairly and promptly.

16. General

16.1 These Terms & Conditions apply to all bookings unless a specific written agreement has been made between the Company and Client.

16.2 If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply.

16.3 The Company reserves the right to update these Terms & Conditions from time to time. The version applicable at the time the booking is confirmed will apply to that booking.

16.4 These Terms & Conditions are governed by the laws of England and Wales.

Soft Play Hire Terms & Conditions

Thank you for choosing us for your special occasion. We want everyone to have a fun, safe and enjoyable experience. Please read these Terms & Conditions carefully before signing.

By signing the agreement, you confirm that you have read, understood and agreed to these Terms & Conditions.

1. Booking & Payment

A booking is confirmed once the required booking fee or deposit has been received and these Terms & Conditions have been accepted.

The remaining balance must be paid by the date stated on your booking confirmation.

We reserve the right to cancel a booking if payment has not been received by the agreed deadline.

2. Hire Period

The hired equipment is supplied for the agreed date and hire period stated on your booking confirmation.

The customer is responsible for the equipment from the time it is delivered or collected until it is collected by us or returned to us.

Please ensure that the equipment is available and accessible for collection at the agreed time.

3. Set-Up & Collection

We will set up the equipment in the agreed location where applicable.

The customer must ensure that there is suitable, clear and safe access to the venue and that the area is ready before our arrival.

Once the equipment has been set up, it must not be moved without our permission.

At collection, please ensure that children and guests are clear of the equipment so that it can be safely dismantled and collected.

4. Adult Supervision

All children using the soft play equipment must be supervised by a responsible adult aged 18 or over at all times.

The soft play equipment must never be left unattended while children are using it.

The customer is responsible for ensuring that children use the equipment safely and appropriately.

5. Suitable Use

The soft play equipment is intended for young children and must only be used for its intended purpose.

Children should not be allowed to:

  • Climb on the sides or walls of the equipment.

  • Stand on or jump from soft play shapes.

  • Throw or misuse the equipment.

  • Push, fight or engage in rough play.

  • Move or remove equipment from its set-up position.

  • Use the equipment in a way that could cause injury or damage.

6. Indoor & Outdoor Use

Unless specifically agreed with us in advance, all soft play equipment is for indoor use only.

Where outdoor use has been agreed, the customer must ensure that the equipment is placed on a suitable, clean and level surface.

The equipment must not be used in rain, strong winds or other unsuitable weather conditions.

The customer is responsible for protecting the equipment from mud, water, dirt, pets and other potential sources of damage.

7. Shoes & Clothing

Shoes must be removed before entering the soft play area.

Children should wear clean socks while using the equipment.

Sharp objects, jewellery, buckles or anything that could damage the equipment should be removed before play.

8. Food, Drinks & Messy Play

To help us keep the equipment clean and hygienic, food and drinks must not be taken onto the soft play equipment.

The following are also not permitted on or around the equipment:

  • Face paint

  • Glitter

  • Slime

  • Pens or felt-tip pens

  • Paint

  • Play-Doh

  • Chewing gum

  • Sticky or messy substances

If the equipment is returned excessively dirty or stained as a result of these substances, a cleaning charge may apply.

9. Hygiene & Cleaning

All equipment is cleaned and sanitised before each hire.

Customers are expected to return the equipment in a reasonably clean condition.

A reasonable additional cleaning charge may be applied where specialist or excessive cleaning is required due to food, drinks, mud, face paint, glitter, slime, bodily fluids, pet hair or other substances.

10. Damage, Loss & Cleaning Charges

We understand that normal wear and tear is expected during the hire period and will not result in any charges.

The customer is responsible for any loss of, or damage to, the hired equipment while it is in their care, where the damage is beyond normal wear and tear.

Charges may apply for:

  • Torn or cut vinyl.

  • Stains caused by food, drinks, face paint, pens, slime, glitter or similar substances.

  • Damage caused by pets.

  • Missing balls, toys or other equipment.

  • Water damage.

  • Damage caused by unauthorised outdoor use.

  • Excessive soiling requiring specialist cleaning.

  • Equipment that is lost or stolen.

  • Equipment damaged beyond economical or safe repair.

Where possible, damaged items will be repaired.

If an item cannot be repaired safely or economically, the customer agrees to pay the reasonable replacement cost of the affected item.

We will provide photographs and details of any damage or cleaning required before issuing an invoice.

Payment of any agreed damage, loss or cleaning charges is due within 7 days of the invoice date.

11. Photographic Records

For the protection of both the customer and our business, photographs of the hired equipment will be taken after it has been fully set up and again at the time of collection.

These photographs provide a record of the condition of the equipment before and after the hire.

Photographs may be used as evidence when assessing any loss, damage, missing items or excessive cleaning requirements.

12. Reporting Damage

If the customer notices any damage or issue with the equipment during the hire period, they must stop using the affected item where appropriate and contact us as soon as possible.

Any concerns regarding the condition or completeness of the equipment should be reported to us immediately upon delivery and before the equipment is used.

13. Moving Equipment

Customers must not move, rearrange, dismantle or alter the soft play equipment once it has been set up.

If equipment needs to be moved for any reason, please contact us first.

Any damage caused by moving or rearranging the equipment may be chargeable.

14. Pets

Pets must be kept away from the soft play equipment at all times.

Any damage caused by pets, including scratches, tears, chewing, hair or staining, may result in a cleaning, repair or replacement charge.

15. Cancellation

If you need to cancel your booking, please contact us as soon as possible.

Any booking fee or deposit will be subject to our cancellation policy and may be non-refundable.

Where appropriate, we may offer the option to transfer a booking to another available date.

16. Adverse Weather

Where outdoor hire has been agreed, we reserve the right to refuse or cancel the outdoor set-up if weather conditions are considered unsuitable or unsafe.

The safety of the children, customers and our equipment is our priority.

Where possible, we will work with the customer to arrange an alternative indoor location or another suitable date.

17. Liability

We take reasonable care to ensure that all equipment is clean, well maintained and suitable for hire.

The customer accepts responsibility for ensuring that children are appropriately supervised and that the equipment is used correctly throughout the hire period.

We cannot accept responsibility for injuries or damage resulting from misuse of the equipment, inadequate supervision or failure to follow the Rules of Play.

Nothing in these Terms & Conditions excludes or limits any liability that cannot legally be excluded or limited under UK law.

18. Collection

The customer must ensure that the equipment is ready and accessible at the agreed collection time.

The equipment should remain in the same location where it was originally set up unless otherwise agreed.

If collection is delayed because the equipment is not accessible or ready, an additional charge may apply where appropriate.

19. Customer Agreement

By signing this agreement, I confirm that I have read, understood and agree to abide by these Terms & Conditions of Hire.

I understand that I am responsible for the hired equipment from the time it is delivered or collected until it is collected by or returned to the hire company.

I agree to take reasonable care of all hired equipment.

I agree to pay the reasonable costs of repairing or replacing any items that are lost, damaged or returned in a condition beyond normal wear and tear, in accordance with these Terms & Conditions.

I understand that photographs of the equipment will be taken after set-up and again upon collection to record its condition before and after the hire.
